By accessing or using the No Sick Days platform, website, or services ("Services"), you agree to be bound by these Terms of Service. If you do not agree, please do not use our Services. These terms apply to all visitors, users, and customers.

2. Description of Services

No Sick Days Pty Ltd provides AI-powered voice agent technology that handles inbound and outbound telephone calls on behalf of businesses. The specific features and limitations of the Services are described in your service agreement or subscription plan.

3. Eligibility

You must be at least 18 years old and have the authority to enter into a binding agreement on behalf of yourself or your organisation to use our Services. By using the Services, you represent that you meet these requirements.

4. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use at hello@nosickdays.com.au.

5. Acceptable Use

You agree not to use our Services to:

• Violate any applicable law or regulation
• Engage in harassment, fraud, or deceptive practices
• Make unsolicited marketing calls in violation of the Do Not Call Register Act 2006 or equivalent laws
• Impersonate any person or entity without authorisation
• Transmit malicious code or interfere with the platform's operation

We reserve the right to suspend or terminate accounts that breach these terms.

6. Call Recording & Compliance

You are solely responsible for ensuring that your use of our voice agent platform complies with all applicable laws regarding call recording and disclosure, including the Telecommunications (Interception and Access) Act 1979. You must ensure all parties to a call are appropriately informed where required by law.

7. Intellectual Property

All content, software, and technology comprising the No Sick Days platform is owned by No Sick Days Pty Ltd or its licensors. You are granted a limited, non-exclusive, non-transferable licence to use the Services for your internal business purposes. You may not copy, modify, or reverse-engineer any part of the platform.

8. Payment & Billing

Fees for the Services are set out in your subscription or service agreement. All fees are in Australian dollars unless otherwise stated. We reserve the right to modify pricing with 30 days notice. Failure to pay may result in suspension of Services.

9. Limitation of Liability

To the maximum extent permitted by Australian law, No Sick Days shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services. Our total liability to you shall not exceed the amounts paid by you in the three months preceding the claim.

10. Termination

Either party may terminate the Services in accordance with the terms of your service agreement. We may terminate or suspend access immediately if you breach these Terms of Service. Upon termination, your right to use the Services ceases immediately.

11. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Victoria.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on our website. Continued use of the Services after changes take effect constitutes acceptance of the new Terms.
